Terms and Conditions

WHEREAS, we have developed the Service for users to advertise and publish advertisements on the Internet; and

WHEREAS, you own and operate one or more websites, applications, offers, services and/or properties (each "Your Property" and collectively "Your Properties"); and

WHEREAS, you desire to buy advertising space or impressions for Your Properties on websites, applications and/or properties operated by other users of the Service ("Third Party Properties") and/or you desire to publish advertising for Third Party Properties on Your Properties; and

WHEREAS, we will grant you the use of the Service to buy and sell advertising space and impressions through the Service in accordance with the terms hereof.

NOW, THEREFORE, in consideration of the recitals and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties make the following agreement:

Affiliate represents and warrants that they are (i) at least eighteen (18) years of age and/or (ii) otherwise recognized as being able to form legally binding contracts under applicable law.
If Affiliate is a corporate entity, Affiliate represents and warrants that they have the legal authority to bind such corporate entity to the terms and conditions contained in this Agreement, in which case the terms "you", "your" or “User” shall refer to such corporate entity.
If, after your acceptance of this Agreement, EvenAds finds that Affiliate does not have the legal authority to bind such corporate entity, Affiliate will be personally responsible for the obligations contained in this Agreement, including, but not limited to, the payment obligations.
EvenAds shall not be liable for any loss or damage resulting from EvenAds’s reliance on any instruction, notice, document or communication reasonably believed by EvenAds to be genuine and originating from an authorized representative of Affiliate’s corporate entity. If there is reasonable doubt about the authenticity of any such instruction, notice, document or communication, EvenAds reserves the right (but undertakes no duty) to require additional authentication.

Sites containing or linking to any form of illegal activity (i.e., how to build a bomb, hacking... etc.).

Sites containing shock gore such as prolapse, bestiality, scatological content such as urine or feces, discriminatory comments, or any depiction of a minor in an adult or sexual situation.

Sites containing child pornography. This includes minors of ay kind, does not matter if they are dressed. "Jailbait" content is included.

Sites with gratuitous displays of violence, obscene or vulgar language, and abusive content or content which endorses or threatens physical harm.

Sites promoting any type of hate-mongering (i.e., racial, political, ethnic, religious, gender-based, sexuality-based or personal, etc.).

Sites that participate in or transmit inappropriate newsgroup postings or unsolicited e-mail (spam).

Sites promoting any type of illegal substance or activity or sites with illegal, false or deceptive investment advice and money-making opportunities.

Sites with any type of content that a reasonable public consensus deems to be improper or inappropriate.

Rates: All advertising rates are subject to change at any time.

Wear and tear: In no event shall either party be liable for special, indirect, incidental, or consequential wear and tear, including, but not limited to, loss of data, loss of use, or loss of profits arising thereunder or from the provision of services.

Liability: Neither EvenAds Media. nor the participating sites will be subject to any liability whatsoever for (a) any failure to provide reference or access to all or any part of the Advertisement URL due to systems failures or other technological failures of EvenAds Media Limited or of the Internet; (b) delays in delivery and/or non-delivery of a campaign, including, without limitation, difficulties with a Publisher or Website, difficulties with a third-party server, or electronic malfunction; and (c) errors in content or omissions in any Advertisement URL provided by Customer.

Deposit & Payments: Publisher payments and Advertiser rebates need to be claimed within 11 months of: (i) a deposit being made (ii) traffic being received In order to maintain the highest standards for our active customers, we may deactivate accounts that are not earning commissions or spending funds for more than 12 months of dormancy.

EvenAds dose not accept and dose not pay for the following kind of traffic. (i) Traffic which are bought from other ad network. (ii) Traffic which are diverted from any traffic exchanger. (iii) Any sort of traffic that is not organic and not directly from the registered publisher website.
